NAATI CCL Dialogue Legal 01 – Direction Hearing

Scenario – A LOTE-speaking applicant attends a directions hearing at the Federal Court after their visa was refused by the Department of Home Affairs. The registrar explains the court process and confirms the applicant wishes to proceed.

Registrar: Good morning. We’re here for a directions hearing regarding your judicial review application. Do you still wish to proceed with your case in the Federal Court?

Applicant: Yes, I’d like to continue. I believe the Department made a mistake when rejecting my visa. I didn’t get a fair chance.

Registrar: Understood. Just to confirm, are your contact details—your address, phone number, and email—still current and correct with the Court?

Applicant: Yes, all my contact details are the same. I check my email often and I’m living at the same address.

Registrar: Thank you. Now, the Federal Court’s role is limited. It doesn’t reconsider your visa or make decisions on whether you should receive one.

Applicant: So the Court won’t give me the visa, even if I win the case?

Registrar: That’s correct. If the Court finds that the Department made a legal or administrative error, it can send the matter back for reprocessing.

Applicant: What kind of mistakes would count as administrative errors?

Registrar: For example, if the Department didn’t give you a chance to respond to concerns, or ignored relevant documents you submitted, those could be errors.

Applicant: Yes, they didn’t ask me for more documents. They just refused my visa straight away.

Registrar: That might be relevant. If the Court agrees an error was made, it will order the Department to assess your application again, from the start.

Applicant: Okay, I understand. So I’ll get a fair process this time, but no promise of a visa.

Registrar: Exactly. You’ll receive a new decision—but the outcome will depend on how the Department assesses your case again.

Applicant: Thank you. I want to continue with my application and hope the Court finds the process was unfair.
